Upon completion of the design, we provide clients with production files, not the design source files. The intellectual property (IP) of the design remains with the designer. If you wish to acquire the design rights, this can be arranged for an additional fee.

Design File Buyout

A design file buyout (purchase of design source files) refers to a one-time payment by the client to obtain editable design source files, such as CAD files, PCB source files, or original drawings. Once received, the client can update, iterate, replicate, or engage another designer to make modifications. Please note that a buyout typically grants usage rights to the files only and does not transfer full intellectual property ownership of the design.

Design Intellectual Property (IP)

Design IP encompasses the legal rights related to a design, including technical solutions, creative concepts, and protection of original work. When a client acquires ownership of a design’s concepts and technical solutions, it prevents the original designer or third parties from reusing or selling the design.

Even if the client has the source files, without an IP transfer, the designer retains certain rights, such as the ability to use the same concepts for other projects with different clients.

Purchasing the design files grants you editable source files only, while acquiring the design’s intellectual property provides legal ownership of the design itself. If you wish to have full control over the design, including preventing others from using it, both the source files and IP rights must be obtained. Fees vary depending on the complexity and scope of the project. Obtaining both is optional and should be decided based on your intended use of the design. NDA Considerations

Some NDAs may contain clauses concerning intellectual property. Be sure to discuss and clarify these terms with your sales representative before signing the NDA.
